Revocation Order 2004
1.On 23 April 2004 Surrey County Council
made -
(a)The Surrey County Council London
Road (A30) Bagshot (Bus Lanes) (No.
1) Order 2004 under Sections 1(1),
2(1) to (3) and 4(1) and Part IV of
the Road Traffic Regulation Act 1984
(the Act); and
(b)The Borough of Surrey Heath (London
Road (A30) Camberley)(Clearway) Order
1982) Revocation Order 2004 under Sections
1 and Part IV of Schedule 9 to the
Act.
2. The purpose and effect of The Surrey
County Council London Road (A30) Bagshot
(Bus Lanes) (No. 1) Order 2004 is to
prohibit all vehicles from entering
or proceeding or waiting in any area
of carriageway (to be known as a 'bus
lanes') lying within or adjacent to
the lengths of London Road (A30) specified
in Schedules 1 and 2 to this Notice
and between the western kerb-line of
that road and a longitudinal single
white line marked on the carriageway
of that road between 7am to
9.30am and 4.00pm to 7.00pm Mondays
to Fridays inclusive.
3. The prohibition referred to in
paragraphs 2 above will not apply to:
-
(a) a bus; or
(b) a pedal cycle; or
(c) a hackney carriage licensed under
section 37 of the Town Police Clauses
Act 1847 and Part II of the Local Government
(Miscellaneous Provisions) Act 1976
or any similar local enactment; or
(d) a vehicle being used for ambulance,
fire brigade or police purposes if
it is reasonably necessary for that
vehicle to enter or proceed or wait
in a bus lane; or
(e) any vehicle being used in connection
with the removal of any obstruction
in a
bus lane; or
(f) any heavy goods vehicle above 7.5
tonnes
(g) a vehicle being used for purposes
in connection with the statutory powers
or duties of a local authority or the
supply of gas, water or electricity,
or in connection with any building
operation, demolition or excavation
in or adjacent to a bus lane, provided
that in all the circumstances it is
reasonably necessary for the vehicle
to enter a bus lane; or
(h)a vehicle -
(i) while postal packets addressed
to premises adjacent to a bus lane
are
being unloaded from that vehicle or,
having been unloaded there from, are
being delivered; or
(ii) while postal packets are being
collected for loading on the vehicle
from
premises or posting boxes adjacent
to a bus lane or, having been so
collected, are being loaded thereon;
or
(i)any vehicle which enters a bus
lane for the sole purpose of waiting
for as long
as may reasonably be necessary to enable
a person suffering from any disability
or injury (including blindness) which
seriously impairs his ability to walk
to
board or alight from that vehicle;
or
(j) any vehicle, which enters or proceeds
in a bus lane: -
(i) from any road if that vehicle forthwith
leaves a bus lane through the
break in the longitudinal single white
line situated opposite and adjacent
to
the junction of that road with that
bus lane; or
(ii)from the exit from Osnaburgh Hill
(also known as 'Osnaburgh Parade')
into the A30 London Road if that vehicle
forthwith leaves a bus lane at a point
opposite and adjacent to the junction
of that exit with the A30 London Road;
(iii) from any part of London Road
(A30) which does not comprise a bus
lane through any break in the longitudinal
single white line if that vehicle forthwith
enters the road which lies opposite
or adjacent to that break; or
(iv) from the two entry points into
Osnaburgh Hill (also known as 'Osnaburgh
Parade') from the A30 London Road if
that vehicle crosses a bus lane at
a point opposite and adjacent to the
junction of that entry with the A30
London Road;
(v) from any vehicular access way or
crossing over the footway adjoining
a
bus lane if that vehicle forthwith
leaves that bus lane at a point opposite
that vehicular access way or crossing;
or
(vi)from any part of London Road (A30)
which does not comprise a bus lane
at a point opposite any vehicular access
way or crossing over the footway adjoining
that bus lane if that vehicle forthwith
enters that vehicular access way or
crossing; or
(vii)from the lay-by lying on the south-east
side of London Road (A30) and fronting
Nos. 423 to 429 London Road and which
is designated for the time being as
a free on-street parking place by The
Borough of Surrey Heath (London Road
(A30) , Camberley) On-Street Parking
Places) (Without Charge) Order (No.
1) 1995 (hereinafter called "the
lay-by") if that vehicle forthwith
leaves the bus lane to be situated
immediately adjacent to the lay-by
at a point opposite or adjacent to
the lay-by; or
(viii)from any part of London Road
(A30) which does not comprise the bus
lane lying immediately adjacent to
the lay-by if that vehicle forthwith
enters the lay-by; or
(k) any vehicle if the driver thereof
is obliged to enter or proceed in a
bus lane in order to avoid an accident
and forthwith causes that vehicle to
leave the bus lane; or
(l) any vehicle if the driver thereof
is required by law to stop and as soon
as reasonably practicable thereafter
causes that vehicle to leave a bus
lane; or
(m) anything done: -
(i) with the permission or at the direction
of a police constable in uniform;
or
(ii) in accordance with any restriction
or requirement indicated by traffic
signs placed on the highway by or on
behalf of the Surrey Police.
4. The purpose and effect of The Borough
of Surrey Heath (London Road (A30)
Camberley)(Clearway) Order 1982) Revocation
Order 2004 under Sections 1 and Part
IV of Schedule 9 to the Act is to revoke
The Borough of Surrey Heath (London
Road A. 30, Camberley) (Clearway) Order
1982 so that that length of the A30
London Road, which runs from the Blackwater
Bridge (i.e. near the County Boundary)
in an easterly direction to a point
86 metres east of its junction with
Kings Ride (northern carriageway) and
86 metres east of its junction with
Knoll Road (southern carriageway) will
no longer be designated as an Urban
Clearway (i.e., no stopping between
7.00 am and 9.30 am, and 4.00 pm and
7 p.m. on Mondays to Fridays inclusive
except for so long as may
be necessary to pick up or set down
passengers).
5. A copy of both of the made Orders,
which will come into force on 1 May
2004, Order revoked, the above-mentioned
Order of 1995, together with the plans
showing the lengths of roads to which
those Orders relate, a Statement of
the Council's reasons for making the
Orders may be inspected, free of charge,
at the -
(a) Legal Services, County Hall, Penrhyn
Road, Kingston upon Thames between
10am and 4pm from Mondays to Fridays
(b) at Surrey Heath Local Transportation
Service, 2 London Road, Bagshot, at
Surrey Heath Borough Council Offices,
Surrey Heath House, Knoll Road, Camberley
during normal office hours and
(c) Camberley Library, Knoll Road,
Camberley Surrey between 10am-8pm Mondays,
10am and 5pm Tuesdays, 10am and 5pm
Wednesdays, 10am and 5pm Thursdays,
10am and 8pm Fridays, 9.30am and 4pm
Saturdays.
6. If you wish to question the validity
of the Order or any provision contained
in it on the grounds that it is not
within the powers conferred by the
Act, or on the grounds that any requirement
of the Act or of any Instrument made
under it has not been complied with
in relation to the Order, you may,
within six weeks from 23 April 2004.
FIRST SCHEDULE
London Road (A30) from the western
kerb-line of Park Street (D3514)
in a south westerly direction to
a point 162 metres north east of
the north east kerb-line of Frimley
Road (B3411), a distance of approximately
760 metres.
SECOND SCHEDULE
London Road (A30) from a point 40 metres
west of the south-western kerb-line
of Frimley Road (B3411) westwards
for a distance of 220 metres.
